Jam Jam respects intellectual property rights. Users’ songs are stored on their own devices and, when signed in, backed up privately to the owner’s account; a song published on a profile is hosted durably and visible to the audience that profile’s visibility defines. If you believe content shared through the Service infringes your copyright, you can ask us to remove it.

Files transmitted for technical processing

Two features send a file to our servers, at your request, for a purely technical and automated processing: converting a sheet of music (image or PDF), and analysing an audio file when you choose to have it done on our server rather than on your device, mobile as well as web. In both cases we act as a mere technical intermediary within the meaning of Article 12 of Regulation (EU) 2022/2065 and Article 6 of the French LCEN: the file is not published, not indexed, not shared and not made accessible to anyone. Not even to another user. It is not attached to your account, and it is deleted as soon as the processing ends (the music file produced by a score conversion is kept for at most 24 hours, long enough for you to collect it; audio uploaded for a server analysis is, in turn, deleted at most after 72 hours). We therefore hold no copy that could be taken down. You remain responsible for having the right to use the file you submit. If you are a rights holder and believe someone is using these features to infringe your rights, write to us: we can suspend an account’s access even where no content of ours remains to be removed.

Soundtracks and stems kept for accounts that follow each other

One case is not covered by the section above, and it needs saying: a soundtrack you attach to a song, together with the voice and instrumental tracks (stems) we automatically separate from it, are kept durably in a private bucket hosted in the EU, and they become available to the accounts that its owner follows and who follow them back once the song is published to their profile. They never leave that mutual circle, they are never indexed, and no download link is ever generated. Before a soundtrack becomes audible to anyone else, the app asks its owner to declare that they hold the rights to share it, and records the date and the version of the text accepted; that declaration covers the stems just as it covers the soundtrack they come from. Such a file can be reported from within the app and we can take it down on notice, like any other content: write to [email protected] with enough detail to locate it. This is the one place where a copy of a recording does survive on our servers, and we would rather write it down than let a rights holder conclude from the paragraph above that there is nothing here to remove.

Songs published on a profile

A public profile durably hosts the songs its owner chose to publish there: chord chart, lyrics, melody, and the address of the website the song came from when it was imported. Any Jam Jam account can see them and import them into its own songbook; the page is also readable on the web without an account, but the lyrics are hidden from a visitor who is not signed in, and those pages are not indexed. A soundtrack never leaves the circle of accounts that follow each other, as the previous section says.

To ask for one of those publications to be taken down, use the report form or write to [email protected]. Give the exact address of the page concerned. The procedure below covers the removal of a piece of content as much as cutting off a link leading to it: we can hide a published song without removing anything from its author’s songbook.

Reporting infringement

Send a notice to [email protected] with:

Your contact information (name, email, address).
Identification of the copyrighted work you claim is infringed.
Identification of the material and enough detail to locate it.
A good-faith statement that the use is not authorised by the rights holder or the law.
A statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorised to act for them.
Your physical or electronic signature.

What happens next

We review valid notices and remove or disable access to the reported material where appropriate, and may notify the user who shared it. We may also cut or restrict a share link without removing anything from its author’s songbook. The old address then states, for twenty-four months, that the content was taken down following a report.

Counter-notice

If your content was removed in error, send a counter-notice to the same address with your contact details, identification of the material, and a good-faith statement that it was removed by mistake.

Repeat infringers

Accounts that repeatedly infringe may be suspended or terminated.

Illegal content other than copyright (EU)

The procedure above follows the US DMCA, because that is the form most rights holders expect. Jam Jam is published from France, so Regulation (EU) 2022/2065 (the Digital Services Act) applies as well, and it is broader: anyone may notify us of any content they believe to be illegal, not only copyright. Write to [email protected] or [email protected] : those are our single point of contact under Articles 11 and 12 of that regulation, in French or English. Tell us what the content is, where exactly it sits, why you believe it is illegal, and how to reach you. We acknowledge receipt, we tell you what we decided and on what grounds, and we tell you what recourse remains open to you, including the courts and out-of-court dispute settlement. When we restrict content, the person who posted it receives the same reasoned explanation and may contest it by replying. Where information suggests an offence involving a threat to life or safety, we inform the competent authorities, as Article 18 requires.
